Heard learned counsel for the petitioners and learned APP for the State.
The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code and later on added Section 302 of the Indian Penal Code. As per FIR that petitioners and several other accused persons came at the door of the informant and specific allegation against Mahboob Alam and Asif Ali is that they stabbed the son of the informant causing injury to him and there is general allegation of assault against these petitioners.
Patna High Court CR. MISC. No.9624 of 2020(2) dt.19-06-2020 2/2 Learned counsel for the petitioners submits that the petitioners are named in the FIR but there is no specific allegation attributed against them. The petitioners have got no criminal antecedent. The similarly situated co-accused have been granted anticipatory bail by Co-ordinate Benches of this Court vide order dated 14.05.2019 passed in Cr. Misc. No.26555 of 2019, order dated 11.07.2019 passed in Cr. Misc. No.42767 of 2019 and order dated 05.08.2019 passed in Cr. Misc. No.48335 of 2019.
In the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Barhariya P.S. Case No. 36 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
