Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Sections 353, 307, 121, 153B and 120B of the Indian Penal Code, Section 17 of the C.L.A. Act, Sections 25(1-b)a, 26 and 35 of the Arms Act and Sections 24, 20, 38, 39, 16A/B/18/18A of the U.A.P. Act.

Petitioner was not there when fire arm was recovered from possession of the co-accused. Petitioner has stated on oath that he has got no criminal antecedent. Investigation of the case is already complete. Petitioner is in custody since 30.12.2020. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.20738 of 2021(2) dt.19-08-2021 2/2 Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sheohar P.S. Case No. 178 of 2013, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
