This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Vishnupad PS Case No. 223 of 2018 for the alleged offence punishable under Section 20/22 of NDPS Act and Sections 25(1-b)a, 26, 27 and 35 of the Arms Act.

It is alleged that 2.5 kg. ganja with arms was recovered in the instant case. Learned counsel representing the petitioner submits that petitioner and his son were arrested in connection with the instant case. He further submits that in fact the petitioner is 70 years of old and he has no concern with the arms and ganja. He has been made accused in this case because he is father of Santosh Singh from whose house the ganja and

Considering the fact that petitioner has no criminal antecedent and being 70 years of old has remained in custody since 19.10.2018, this application is allowed. Accordingly, let the petitioner above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge-cumSpecial Judge, Gaya in connection with Vishnupad PS Case No. 223 of 2018.
