The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 406, 409 and 420 of the Indian Penal Code.

It is a case of embezzlement of the government money by the accused persons including the petitioner. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that the work of Pay Jal Yojana was decided to be done by the Mahi Traders (contractor) in the decision of Ward Kriyanayavam Aivan Prabandhan Samiti and for the said purpose cheques were issued to Mahi Traders & others in lieu of Pipes and other materials supplied in the aforesaid work and

He further submits that almost 95% work has been done by the contractor and total amount of work is Rs.14,00,000/- onwards, out of which amounting to Rs.4,00,000/- onwards is still dues to be paid by the concerned department regarding completion of the final work of Pay Jal Yojana of Ward No. 4 Gram Panchayat Laheri and petitioner is ready to complete the work. However, learned APP for the State has opposed the anticipatory bail of the petitioner.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-1, Sasaram, Rohtas in connection with Kochas P.S. Case No. 134 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
