JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-04-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26, 35 of the Arms Act.

Petitioner and one Ashok Manjhi were caught while police made raid to recover the kidnapped victim of Kajra P.S. Case No. 06 of 2016. At the time of arrest, one masket and one live cartridge are said to have been recovered from possession of the petitioner.

Submission on behalf of the petitioner is that petitioner is in jail custody since 23.01.2016 and moreover, petitioner has already been acquitted in Kajra P.S. Case No. 06 of

Patna High Court Cr.Misc. No.13765 of 2017 (2) dt.26-04-2017 2/2 2016 corresponding to Sessions Trial No. 184 of 2016. Considering the period of detention of the petitioner in jail custody as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Kajra P.S.
