JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-03-2017 The petitioner is in custody since 27.09.2016 in connection with Thakurganj P.S. Case No. 82 of 2016, registered for offences punishable under Sections 302, 201, 34 of Indian Penal Code.

It has been submitted on behalf of the petitioner that save and except suspicion, there is nothing against the petitioner so as to connect him with the present case for which he has been languishing in judicial custody since 27.09.2016. Learned counsel for the State opposed the prayer for bail and submitted that several paragraphs of the case diary supports the case of the prosecution and it has come that the petitioner has illicit relationship with the wife of the deceased and hence, there is strong suspicion about the involvement of this petitioner in the

Having heard both sides, in view of the allegation and also in view of the fact that there is strong suspicion about the involvement of the petitioner in the alleged offence, as such, I am not inclined to grant him the privilege of regular bail, it is accordingly rejected.

However, the trial court is directed to expedite the trial and try to conclude it as soon as possible preferably within a period of nine months.
