The instant application has been filed for modification of order dated 22.6.2020 passed in Cr. Misc. no.11778 of 2020 whereby while granting bail to the petitioner in connection with Sono (Charka Pathar) P.S. Case no.169 of 2017, the petitioner was directed to surrender in the learned court below within eight weeks.

It is submitted by learned counsel for the petitioner that the petitioner could not surrender for reasons beyond his control as also the situation arising out of Covid-19 pandemic. Further, in compliance of the direction of this Court, cost of Rs.5,000/ has been deposited in the Patna High Court Legal Services Committee.

No.15592 of 2021(3) dt.06-10-2021 2/2 Having heard learned counsel for the parties, the instant modification application is allowed and the order dated 22.6.2020 passed in Cr. Misc. no.11778 of 2020 is modified to the extent that the period granted to the petitioner to surrender in the learned trial court is extended for a further period of six weeks from today. Remaining part of the order dated 22.6.2020 shall remain unchanged.

The application stands allowed.
