2. The petitioner apprehends his arrest in connection with Complaint Case No. 1106 of 2024, registered for the offences punishable under Section 498(A) of the IPC.

3. It is a case of matrimonial dispute. As per FIR, the petitioner, who is husband of the victim, tortured her for non- fulfillment of demand of dowry. It is further alleged that the complainant was ousted from her matrimonial house after snatching her ornaments.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. Petitioner has never made any dowry demand and has been falsely implicated in the present case merely on suspicion and grudge. He has also submitted that the petitioner is ready to pay Rs. 5,000/- per month as interim maintenance to the complainant.

5. On the other hand, the learned APP for the State and the learned counsel for the complainant have opposed the prayer for bail by submitting that the informant is passing miserable days in financial scarcity in her paternal house.

Considering the above-mentioned facts and circumstances, especially the fact that the petitioner is ready to pay Rs. 5,000/- per month as interim maintenance to the informant, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 2nd Class, Motihari, East Champaran in connection with Complaint Case No. 1106 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C.

7. The petitioner is directed to pay Rs. 5,000/- per month as interim maintenance to the complainant. The amount of maintenance passed by any other forum shall be adjusted in that amount.
