The petitioner seeks bail in connection with Kurlikot P.S. Case No.39/16 registered under Sections 328, 302,34 of the Indian Penal Code and Section 3⁄4 of D.P.Act. The allegation of the informant is that he performed marriage of his daughter Sanjila Khatoon with the petitioner. Thereafter petitioner and other in-laws used to torture due to nonfulfillment of demand of dowry Rs.2/- but he showed his inability to fulfill their dowry demand. In the night of 27.8.2016 the informant went to the matrimonial house of his daughter on hearing hallah but he was not allowed to meet his daughter and he was told that his daughter had some abdominal pain and on his

No.13422 of 2017 (3) dt.19-04-2017 2/2 pressure his daughter was rushed to P.H.C., Thakurganj and when condition was deteriorating she was taken to West Bengal Medical College where his daughter informed that she was assaulted and her mother-in-law administered some medicine to her forcibly. In course of treatment his daughter died.
Learned counsel for the petitioner submits that petitioner is the husband of deceased who died due to illness but with ulterior motive informant the father of the deceased lodged the present case with false allegation. The petitioner has no criminal antecedent and is in custody since 5.10.2016. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kishanganj, in Kurlikot P.S.
