The petitioner seeks bail in connection with Sessions Trial No.685 of 2016, arising out of Rahui (Bhagan Bigha) P.S. Case No.90 of 2011, registered under Sections 302 and 120B of the Indian Penal Code besides Section 27 of the Arms Act. Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, it has come that prior to the alleged occurrence, the petitioner had given threatening to the deceased Suresh Kumar Sinha, the father of the informant Sunil Kumar Sinha, which is detailed in paragraph-27 of the case diary. Except that, there is

Patna High Court Cr.Misc. No.7647 of 2017 (5) dt.03-05-2017 2/2 nothing against the petitioner to connect him the commission of the alleged offence. The petitioner is in custody since 25.11.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-III, Nalanda at Bihar Sharif, in connection with Sessions Trial No.685 of 2016, arising out of Rahui (Bhagan Bigha) P.S. Case No.90 of 2011. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner.
