JUSTICE SUDHIR SINGH ORAL ORDER 18-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147, 148, 149 and other allied Sections of the Indian Penal Code and Section 3(2) (v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Prosecution case is that due to land dispute petitioners came to the house of the informant and started assaulting his mother Savitri Devi. When Savitri Devi was taken to Hospital, she was declared dead.

It is submitted on behalf of the petitioners that they have got no criminal antecedent. There is no specific injury attributed to the petitioner. General and omnibus allegation has been made against the petitioners.

On behalf of the State, it is submitted that petitioners are named in the F.I.R. and they were present at the time of occurrence at the place of occurrence.

Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioners, same is

Patna High Court Cr.Misc. No.5479 of 2016 (2) dt.18-03-2016 2/2 rejected.

Any how, if petitioners surrender in the court below, i.e., learned A.C.J.M., Birpur (Supaul.), in connection with Birpur P. S. Case no. 207 of 2015 within a period of six weeks from the date of receipt of a copy of this order and pray for regular bail, same shall be considered and disposed of on its own merit without being prejudiced by this order.
