JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 09-08-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has filed the instant application for modification of the order dated 12.10.2022, whereby while granting anticipatory bail to the petitioner in connection with Mahila PS Case No. 14 of 2021, the petitioner was directed to surrender in the Court below within a period of four weeks with a condition to deposit monthly maintenance of Rs. 4,000/- per month and at the time of filing bail bond he will show the receipt of deposit of Rs. 4,000/- in the account of the informant. It is submitted by learned counsel for the petitioner that informant has not provided her account number to the

Patna High Court CR. MISC. No.22300 of 2023(3) dt.09-08-2023 2/2 petitioner so he could not deposit any amount as a result of which he could not file bail bond within stipulated time. In contra, learned counsel for the informant has submitted that today he will provide bank account number of the informant to the petitioner.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner and the contents of the modification application, the Court is inclined to allow the prayer of the petitioner. The order dated 12.10.2022 passed in Cr. Misc. No. 27501 of 2022 is modified and the time granted to the petitioner in the said order to surrender in the learned Court below is extended by a further period of four weeks from today. The bail bonds of the petitioner shall be accepted by the learned court below on showing receipt of deposit of Rs. 4,000/- by the petitioner in the account of the informant. The remaining part of the order shall remain unchanged.
