The petitioners, namely, Most. Nageshwari Devi and Binod Kumar Keshari, apprehend their arrest in Buxar (M) P.S. Case No. 63 of 2015 under Sections 420, 467, 468, 471/34 of the Indian Penal Code.
The informant alleged that during the life time of Bishwanath Keshari and Kailash Keshari, S/o Shiv Narain Keshari, there was a partition among the branches of the informant and Shiv Narain Keshari, but Vinod Kumar Keshari and his mother Nageshwari Devi, W/o late Bishwanath Keshari, executed a sale deed with regard to the land which did not fall in their share. The case of the petitioners is that they are the owner of the property. The informant is illegally claiming over the land to be

The informant did not bring any fact along with the F.I.R. showing partition of the property and the land falling in his share. The dispute is of civil nature.
Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in Buxar (M) P.S. Case No. 63 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
