Mr. Bhaskar, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 24-06-2026 Heard Mr. Krishna Prasad Singh, learned Senior counsel for the petitioner and the State beside Mr. Bhaskar representing the informant.

2. The petitioner is apprehending his arrest in connection with Daudnagar P.S. Case No. 582 of 2025 for the offence under sections 109, 190, 191(2), 126(2), 115(2) and 117(2) of the BNS lodged on 09.09.2025 by the informant, Surajmal Singh.

3. As per the prosecution story, the informant alleged that on the issue of construction of road, the accused persons armed variously, assaulted the informant's side and in the process, allegation against the petitioner is of assaulting Geeta Devi with khanti causing injuries to her. Anshu Kumar and Maya Kumari also assaulted causing injury on the eyes of Geeta Devi. Further, informant was assaulted by Sant Kumar and Rishi Kumar who also assaulted his uncle while Amar Kant was assaulted by

Patna High Court CR. MISC. No.14456 of 2026(5) dt.24-06-2026 2/2 Pushpanja Kumar and Meena Devi. This led to the FIR.

4. Learned Senior counsel for the petitioner submits that there is case and counter-case, both sides have suffered and it was due to the construction of road but exaggerated FIR has been lodged.

5. Learned counsel for the informant submits that the injury inflicted by the petitioner to the injured Geeta Devi has found to be grievous in nature and the petitioner has criminal antecedent also.

6. The Coordinate Bench had called for the case diary and the injury report which are available on record and as per the injury report dated 04.01.2026, number of injuries have been found on the person of Geeta Devi which include fracture on the occipital region as also the nasal bone.

7. Considering the aforesaid facts as also the injuries inflicted by him, no relief can be extended.
