JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 01-06-2015 Learned counsel appearing on behalf of the petitioners submits that the petitioner no.3, Krishna Kumar Singh, has already been arrested by the police in this case and, as such, this application in respect of him has become infructuous. In that view of the matter, learned counsel appearing on behalf of the petitioners prays for permission to withdraw this application in respect of petitioner no.3, Krishna Kumar Singh. Permission is accorded.
This application in respect of petitioner no.3, Krishna Kumar Singh, is dismissed as withdrawn.
Patna High Court Cr.Misc. No.10568 of 2015 (3) dt.01-06-2015 2/3 Now, this application shall proceed only as against the petitioner nos.1, 2 and 4.
Heard learned counsel for the petitioner nos.1, 2 and 4 and the learned A.P.P. for the State.
The petitioner nos.1, 2 and 4 apprehend their arrest in connection with Town P.S. Case No.219 of 2012 registered under Sections 420, 467, 468, 470 and 471 of the Indian Penal Code. Certain forgeries are alleged to have been committed in the records of the office of the Sub-Registrar, Chapra. Learned counsel appearing on behalf of the petitioner nos.1, 2 and 4 submits that the petitioners are not named in the F.I.R. In course of investigation suspicion has been raised against them as one Surendra Kumar has claimed that he has filed Title Suit No.808 of 2013 against the petitioners, which is pending in the court of Sub Judge-I, Saran at Chapra. Except that, there is nothing against the petitioner nos.1, 2 and 4 to connect them in the commission of the alleged offence.
Having considered the facts and the circumstances of the case, let the petitioner nos.1, 2 and 4, above named, in the event of their arrest or surrender by them within four weeks, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the
