The petitioner seeks bail in a case registered under Sections 302/ 34 of the Indian Penal Code.

Allegedly, the accused persons called the informant's son and killed him wrapping a rope around his neck. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 07-09-2018. Charge sheet has already been submitted. As per FIR, suspicion has been raised against co-accused namely Suresh Paswan and Ganesh Paswan for committing the murder of the deceased. There is no eye witness to the alleged occurrence. So far the petitioner is

Patna High Court CR. MISC. No.13180 of 2019(5) dt.19-07-2019 2/2 concerned; it is alleged that he had thrown the dead body in front of the house of the deceased. The other co-accused with similar allegation has been granted bail by a coordinate bench of this court vide order dated 03-06-2019 passed in Cr. Misc. No. 19544 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-I-cum-Special Judge, Vaishali at Hajipur in connection with Sessions Trial No. 423 of 2018 arising out of Vaishali P.S. Case No. 286 of 2012 .
