JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 30-01-2016 This Court finds it rather strange and unacceptable that an authorization in favour of the petitioner for payment of sum of Rs.4,10,782/- under the G.P.F. head made as far back as 15.07.2014 has not accrued in his favour as is the stand of the counsel for the petitioner on instruction.
The writ application is disposed of with a direction upon the Director, Provident Fund, Government of Bihar that he will take cognizance of his own sanction order and verify as to why the payment has not been made.
In addition to that, the Court also directs the Executive Engineer, National Highway, East Division, Patna that he has a duty and obligation to ensure that this payment, if not already made over to
Patna High Court CWJC No.4732 of 2014 dt.30-01-2016 2 / 2 the petitioner, will be made over within a period of ten weeks from the date of production of a copy of this order. It is made clear that if the petitioner is harassed without any justifiable cause, the Court will surely come down heavy on the concerned respondents if a grievance is raised before this Court for non-compliance of the direction issued by this Court.
