JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 30-09-2016 Heard Mr. D.K.Sinha, Senior Counsel, for the petitioner and the Counsel for the Oriental Insurance Company Ltd (for short „the Company‟) The writ application prays for as under:- "1. That the present writ application is directed for issuance of an appropriate writ/writs for quashing the order contained in letter dated 29/01/13 issued by the Respondent no. 3 (Annexure-7) and for a direction upon the respondent to issue necessary orders approving the claim of the petitioner correcting his address."

Counsel for the Company has rightly pointed out that any

Patna High Court CWJC No.4442 of 2014 (2) dt.30-09-2016 2/2 such claim can either be raised before the Ombudsman of the Company or before the Consumer Forum. In the case at hand, the petitioner has already moved the Consumer Forum vide Complaint Case No. 20 of 2013.

Mr. Sinha, Counsel for the petitioner states that the Complaint Case no. 20 of 2013 is pending on the file of the District Forum for a long time. The forum should be directed to take up the matter and dispose of the same expeditiously. Having heard the parties, the application is disposed of with a direction upon the respondent nos. 6 and 7 to take up the Complaint Case No. 20 of 2013 and proceed to dispose of the same in accordance with law as quickly as possible preferably within six months from the date of receipt/production of a copy of this order.
