JUSTICE SATYAVRAT VERMA ORAL ORDER 11-03-2022 Heard learned counsel for the petitioner and Ms. Suman Kumar Singh learned A.P.P. for the State. The petitioner seeks bail in connection with Excise Case No. 184 of 2020 instituted for the offences under Sections 30(a), of the Bihar Prohibition & Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 07.01.2022, prosecution report submitted and has antecedent of two cases, and allegation is of recovery of 81 liters of liquor from a hut.

Learned counsel for the petitioner submits that petitioner was not arrested from the spot nor the hut from where the liquor was recovered belongs to him.

Learned A.P.P. for the State vehemently opposes the

Patna High Court CR. MISC. No.11218 of 2022(2) dt.11-03-2022 2/2 prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 07.01.2022 and petitioner was not arrested from the spot and prosecution report submitted, let the petitioner above named be released on bail on furnishing bail bond of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Court No. 2, Samastipur in connection with Excise Case No. 184 of 2020.
