ANJANA MISHRA ORAL ORDER 03-03-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners are apprehending their arrest in connection with Telhara P.S. Case No. 138 of 2015, registered for offences punishable under Sections 47, 341, 323, 337, 504, 429 and 308/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that all the allegations made against the petitioners are under the bailable section and the provisions of section 308 have alone been used to bring the petitioners under the ambit of a non-bailable section so as to put the petitioners behind the bar. Learned counsel for the petitioners further submits that the informant himself is an anti
Patna High Court Cr.Misc. No.5101 of 2016 (2) dt.03-03-2016 social character and so far as these petitioners are concerned they have no criminal antecedent.
Considering the nature of allegation made against the present petitioners and also that they have no criminal antecedent, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Telhara P.S. Case No. 138 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
