This application, for grant of anticipatory bail, arises out of Bahera Police Station Case No. 162 of 2020, disclosing offences under Sections 147, 148, 149, 341, 323, 325, 379, 504, 506 of the Indian Penal Code.
The learned counsel for the petitioner has submitted that the present petitioner has lodged Bahera P.S. Case No.159 of 2020 which is prior to the present case. That case was lodged on 6th May, 2020 and the present case was lodged on two days thereafter, i.e., 8th May, 2020.
The learned counsel has also submitted that there is
Patna High Court CR. MISC. No.22285 of 2021(2) dt.25-01-2022 2/2 no specific allegation of assault against the present petitioner rather it is against co-accused, Surendra Yadav, Madan Yadav and Dhanjay Yadav.
Learned Addl. P.P. has opposed and the prayer for bail.
Considering the aforementioned fact and circumstances, let the petitioner, named above, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Benipur, Darbhanga, in connection with Bahera Police Station Case No. 162 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
