The petitioner seeks bail in connection with Konch P.S. Case No. 510 of 2022 instituted for the offence under Sections 147, 148, 149, 307, 354, 379, 504 & 506 of the Indian Penal Code.

Prosecution case in short is that informant was assaulted by the accused persons, including the petitioner, due to which he sustained injury on head. It is also all alleged that accused persons tried to outrage the modesty of female members of the informant's family.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.16903 of 2024(2) dt.13-03-2024 2/3 that the petitioner is in custody since 19-12-2023. Petitioner is stated to be man of clean antecedent.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case due to dirty village politics. There is no specific allegation levelled against the petitioner. There is case and counter case between the parties. Nothing has been recovered from the conscious possession of the petitioner. Similarly situated coaccused have been granted bail by a Co-ordinate Bench of this Court vide order dated 12-09-2023, passed in Cr. Misc. No. 59378 of 2023 and order dated 09-08-2023, passed in Cr. Misc. No. 48750 of 2023.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, clean antecedent of the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Konch P.S.
