JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-08-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks pre-arrest bail in (Muzaffarpur) Town P.S. Case No. 487 of 2021, registered for the offence punishable under Sections 420, 379, 467. 468, 120(B) and 34 of the Indian Penal Code.

As per the FIR, SIM card of informant was supplied to an impersonator which was misused for defrauding the informant of Rs. 22,40,000/- from his account through online banking.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He is not named in the FIR. Petitioner's name has figured during course of investigation in confessional statement of co-

No other substantive evidence has been collected during course of investigation to suggest the implication of this petitioner in the present case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has got no criminal antecedent.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in Town Police Station Case No. 487 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
