JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Section 436 of the Indian Penal Code.
It is alleged that seven accused persons abused, assaulted and set the house of the complainant on fire. It is submitted by learned counsel for the petitioners that for the occurrence of 17-21.12.2011, the complaint was filed on 31.01.2012. The petitioners are related to the complainant and in the background of land dispute, the accusation has been levelled. A statement has been made in para 3 of the petition that the
Patna High Court Cr.Misc. No.6523 of 2015 (2) dt.19-02-2015 2/2 petitioners have no criminal antecedent.
Considering the delayed lodging of the complaint, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Supaul in connection with Complaint Case No. 92C of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C.
