This application for regular bail arises out of Udwant Nagar, (Gajrajganj O.P.) P.S. Case No. 492 to 2019 disclosing offences punishable under Sections 279, 337, 338, 304 and 427 of the Indian Penal Code.

It is alleged in the F.I.R. that the petitioner was recklessly driving a truck which hit the informant's brother and sustained serious injuries, He finally succumbed to the injuries. The petitioner is in custody since 25.12.2019. Learned counsel appearing on behalf of the petitioner has submitted that even if what has been alleged in the F.I.R. is treated to be correct, no offence under Section 304 of Indian Penal Code can be said to be made out.

Let the petitioner above named be released on bail furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Udwant Nagar (Gajrajganj O.P.)
