JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-02-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of anticipatory bail arises out of Raxaul P.S. Case No. 105 of 2011, disclosing offences under Sections 406,409,420/34 of the Indian Penal Code. It transpires from the records that application for grant of anticipatory bail preferred by co-accused Sunil Kumar alias Sunil Kumar Sharma and Randhir Kumar have been rejected by this Court by orders dated 10.01.2013 and 21.06.2013 passed in Cr. Misc. No. 63 of 2013 and Cr. Misc. No. 1238 of 2013 respectively.

Learned counsel for the petitioners, referring to the order dated 21.06.2013 passed by this Court in Cr. Misc. No. 1238 of 2013 in case of Randhir Kumar, submits that this application shall also be disposed of in terms of the said order. Accordingly, this application is disposed of with a direction to the petitioners to surrender before the Court below within four weeks from today and if they agree to deposit the amount in question, the Court below shall consider the application, without being prejudiced by the rejection of the present application for anticipatory bail.
