2. The petitioners apprehends their arrest in connection with Kasma P.S. Case No. 176 of 2023, registered for the offences punishable under Sections 353, 341, 504, 506, 147, 149 of the Indian Penal Code.
3. As per allegation, the petitioners along with other 19 named co-accused persons and 30-40 unknown persons were
Patna High Court CR. MISC. No.13606 of 2024(2) dt.12-03-2024 2/2 protesting on the road against the police personnel by keeping dead body of son of Sudama Choudhary on the road which caused disruption. Further the accused persons also burnt tyres which created jam on the road.
4. Learned counsel for the petitioners has submitted that the FIR itself shows that not a single person has suffered any kind of injuries. So far as petitioner nos. 1, 2 ,3, 5 and 6 are concerned they have no criminal antecedent and so far as petitioner no. 4 is concerned he has one criminal antecedent of similar nature on which he is on bail.
Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Aurangabad in connection with Kasma P.S. Case No. 176 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.
