The petitioners seek bail in Dumariya P.S. case No. 02/ 2017 under Section 386, 387/34 of the Indian Penal Code. The informant alleged that extortion was demanded from him from mobile No. 7321810214 and from mobile No. 9430095501 in the name of Dhoni, Regional Commander of T.P.C. The informant again received call from the same mobile on 02.01.2017. The informant requested the caller to disclose the name and place where money was to be delivered. The informant informed the police. The informant went there. The petitioners came and demanded money but, in the meanwhile, both the petitioners were apprehended by the police.
The learned counsel for the petitioners submits that informant is a Mukhiya. Petitioner No.1 canvassed against the
Patna High Court Cr.Misc. No.15770 of 2017 (3) dt.18-05-2017 2/2 informant during the Panchayat election. Petitioner No.2 is fatherin-law of petitioner No.1 and he had gone to the house of his daughter but he has also been implicated in the case. The seizure list does not bear the signature of the petitioners. The petitioners have got no criminal antecedent but it appears that petitioners demanded extortion and the informant went to pay the extortion money but both the petitioners, who had gone there to collect extortion money, were apprehended by the police. Considering the nature of allegation made against the petitioners, I am not inclined to enlarge the petitioners on bail, at this stage. Accordingly, the same is rejected.
