JUSTICE JYOTI SARAN ORAL ORDER 29-03-2016 Heard Mr. Gagandeo Yadav, learned counsel appearing for the petitioners and learned counsel for the State. The two petitioners apprehend their arrest in connection with Complaint Case No.358(C) of 2015 for the offences punishable under sections 323, 341,406,420, 504 and 120B/34 of the Indian Penal Code.
Mr. Yadav, learned counsel appearing for the petitioners with reference to the petition of complaint present at Annexure-1 has submitted that the main allegation is directed against accused Birju Choudhary of entering into an agreement with the complainant for sale of a land and of having obtained consideration amount as well to the tune of Rs.14,30,000/- but
Patna High Court Cr.Misc. No.5127 of 2016 (2) dt.29-03-2016 thereafter has retracted from his commitment. The petitioners happen to be the mother and brother of the accused and the allegation against them is that the accused has instead transferred the land in favour of these persons. Having heard learned counsel for the parties and considering the nature of allegation, let the petitioners, namely, Most. Shila Devi @ Sushila Devi and Bijendra Choudhary @ Bijendra Kumar in the event of their arrest or surrender within four weeks from today be released on bail upon each of them furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur, Patna in connection with Complaint Case No.358(C) of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
