JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-01-2022 Let the defects, if any be removed within four weeks of the complete start of the physical Court. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Complaint C2 of 2020 registered for the offences punishable under Sections 30(a) and 56(b) of the Bihar Prohibition and Excise Act.

On secret information, police intercepted two boats carried 40 liters of Mahua liquor, were recovered. It is submitted that petitioner has no concerned with the said liquor and other materials and he has not caught on the spot. Petitioner has clean antecedent.

Patna High Court CR. MISC. No.21880 of 2021(2) dt.03-01-2022 2/2 Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that petitioner in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge cum Special Judge, Excise, Lakhisarai in Complaint Case No. 169C2 of 2020 subject to condition as laid down under Section 438(2) of the Cr.P.C.
