====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 21-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Ramgarhwa P.S. Case No. 284 of 2018, instituted for the offence under Section(s) 399 and 402 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner has been arrested by the police merely on suspicion. It is alleged in the written report that informant found one Alto Maruti Car and one Yamaha Motorcycle of Nepali number parked in middle of the road and five persons were standing there. On seeing the police party, they started running away. Two persons along with petitioner have been arrested by the police and two managed to run away. On search

Patna High Court Cr.Misc. No.10418 of 2019(2) dt.21-02-2019 2/2 besides Alto car, two knives, one iron rod and one fighter were recovered from possession of the apprehended persons. Counsel for the petitioner submits that in the seizure there is no mention that recovery has been made from possession of the petitioner.

Petitioner is in custody since 29.11.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul at Motihari, in connection with Ramgarhwa P.S. Case No. 284 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
