The petitioner, who is in custody since 02.12.2019 seeks bail in connection with Hulasganj P.S. Case No. 91 of 2017 dated 02.08.2017 instituted for the offence under Sections 366/34 of the Indian Penal Code.

According to the prosecution version, the petitioner is said to have eloped with the daughter of the informant, namely, Sudha Kumari, who is stated to be aged about 15 years. The victim girl has been recovered and her statement under Section 164 Cr.P.C. has been recorded, in which, she clearly stated that she knew the petitioner from before as he

Patna High Court CR. MISC. No.10229 of 2020(3) dt.01-06-2020 2/2 is the grandson of her elder grandfather. No misdemeanor has been alleged against the petitioner.

Regard being had to the nature of accusation against the petitioner, his period of custody and the statement of the victim girl under Section 164 Cr.P.C, the petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Jehanabad in connection with Hulasganj P.S. Case No. 91 of 2017.
