The petitioner is an accused in connection with Islampur P.S. Case No. 277 of 2016, registered under Sections 392 of Indian Penal Code, pending in the Court of Addl. Chief Judicial Magistrate, Hilsa, Nalanda.
The accusation is of committing robbery of mobile, cash and motorcycle of the informant and his associate by the three unknown on18.10.2016 at about 9.30 P.M.
Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the petitioner was apprehended by the Police showing the recovery of mobile set, which is said to be robbed and on the basis of confessional statement of the petitioner, the robbed motorcycle was also recovered.
Patna High Court Cr.Misc. No.13431 of 2017 (2) dt.24-03-2017 2/2 Learned counsel for the State vehemently opposed the prayer of the petitioner.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner, above named, is rejected.
