Petitioner seeks bail in a case registered for the offences punishable under Sections 395 and 412 of the Indian Penal Code.
The petitioner and others were apprehended by the police when they were fleeing after robbing the informant. The looted articles were also recovered. Petitioner is in custody since 07.11.2018. Petitioner has stated on oath that he has got no criminal antecedent.
Considering the nature of allegation and material, I am not inclined to enlarge the petitioner on bail in connection with Araria Police Station Case No. 770 of 2018 pending in the court of learned Chief Judicial Magistrate, Araria. Hence, prayer for bail is refused.
Patna High Court CR. MISC. No.12002 of 2019(3) dt.07-05-2019 2/2 Learned trial court is directed to expedite the trial and conclude the same preferably within a period of nine months from the date of receipt/production of a copy of this order, failing which the petitioner would be at liberty to renew his prayer for bail before the learned court below who shall pass a reasoned order.
