2. Earlier, the regular bail application of the petitioner was rejected by this Court vide order dated 11.12.2023 in Cr. Misc. No. 60982 of 2023 with a direction that petitioner will be at liberty to renew his prayer for bail after framing of charge.

3. The petitioner has prayed for regular bail in this case in connection with Darpa P.S. Case No. 53 of 2023 instituted for the offence under Sections 302, 201 and 34 of the Indian Penal Code.

4. Learned counsel for the petitioner submitted by way of supplementary affidavit that charge has been framed against the petitioner in this case in Sessions Trial No. 1039/2023 and in support of this Annexure-3 has been annexed in this petition.

5. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Darpa P.S. Case No. 53 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 21th Additional Sessions Judge, East Champaran, Motihari.
