The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47(A) of the Excise Act. It is alleged that from the house of the petitioner 60 liters of country made liquor was recovered.

It is submitted by the learned counsel for the petitioner that the seizure list does not appear signature of any member of the family. The recovery made from the joint family house of the petitioner. The First Information Report was lodged on 01.04.2014 but the same was transmitted to the learned Judicial Magistrate on 05.04.2014 which suggests that First Information Report has been registered by ante dating. Statement has been made in para-3 of the petition that

Patna High Court Cr.Misc. No.6593 of 2015 (2) dt.19-02-2015 petitioner has no criminal antecedent.

Considering the delayed transmission of the First Information Report to the court clouds the accusation, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Patna in connection with Shahpur P.S.
