====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-12-2021 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Learned counsel for the petitioners are expected to honour their undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office. The petitioners are apprehending his/their arrest in connection with Basopatti P.S. Case No. 184 of 2020 for the offence registered under Sections 447, 341, 323, 324, 307, 379, 504, 427 and 34 of the Indian Penal Code.

The prosecution case in brief is that the petitioners along with other accused persons assaulted the informant and

Learned counsel for the petitioner submits that the petitioners have falsely been implicated in connection with the present case. It is further submitted that both the parties sustained injuries. However, on perusal of the injury report as contained in Annexure-2, it appears that the injuries are simple in nature. It is further submitted that there is land dispute between the parties and the petitioners have no criminal antecedent.

Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Madhubani in connection with Basopatti P.S. Case No. 184 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
