JUSTICE SUDHIR SINGH ORAL ORDER 28-03-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Bhabua P.S. Case No. 186 of 2014 for the offences instituted under Sections 506, 307, 341 and 504/34 of the Indian Penal Code.

As per prosecution case the petitioner and his father pressurized the informant's son while he had gone to market to give them liquor but he refused and returned back his home, both the accused came to his house and started abusing the informant and his son and threatened to kill them and both the accused caught hold of the informant and started dragging him from his house and Munna Ram put pistol over his head and petitioner is

Patna High Court Cr.Misc. No.5644 of 2016 (2) dt.28-03-2016 also alleged to have armed with country made pistol. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. General and omnibus allegation has been made. In course of investigation, police has submitted final form against the petitioner.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Bhabua P.S. Case No. 186 of 2014/Trial No.1041 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Ajit Kumar Singh, Judicial Magistrate, Ist Class, Bhabua (Kaimur), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
