2. The petitioner seeks regular bail in a case registered for the offence punishable under section 366A/34 of the Indian Penal Code.
3. As per the prosecution case, all the FIR named accused persons kidnapped 14 years old informant's daughter for the purpose of marriage when she had gone to attend call of nature.
4. Learned counsel appearing for the petitioner submits that the petitioner is not named in the FIR. However, he has been implicated in this case because he happens to be father of co-accused Police Singh who is named in the FIR. No role has been assigned to this petitioner either in the FIR or during course of investigation. Later on, said Police Singh has been acquitted by this Court vide judgment dated 6.12.2023, passed
Patna High Court CR. MISC. No.17377 of 2024(5) dt.09-08-2024 2/2 in Cr.Appeal No.1015 of 2019. F.I.R. has been lodged after delay of six days without any explanation which renders the entire prosecution case doubtful. Charge sheet has already been filed. Petitioner is in custody since 20.9.2023.
5. Considering the aforesaid facts of the case, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in Isuapur Police Station Case No. 124 of 2015.
