JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 04-07-2023 At the outset, learned counsel for the petitioner seeks permission to withdraw this anticipatory bail petition in respect of petitioner no.2, Nagiya Devi @ Nagina Devi as she has already been apprehended by the police.

Permission is granted.

Accordingly, this anticipatory bail petition is dismissed as withdrawn so far as petitioner no.2, Nagiya Devi @ Nagina Devi is concerned.

This anticipatory bail petition survives only against petitioner no.1, Surajdev Yadav @ Surya Dev Yadav. Heard learned counsel for the parties.

The petitioner apprehends his arrest in connection with Khizersarai P.S. Case No.385 of 2022, registered for the offences punishable under Sections 304(B) and 201 of the Indian Penal Code.

Patna High Court CR. MISC. No.12724 of 2023(4) dt.04-07-2023 2/2 Accusation is of killing the daughter of the informant for non-fulfillment of demand of additional dowry. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that no specif overt act is alleged against the petitioner. Learned APP for the State and learned counsel for O.P. No.2 opposed the prayer for grant of anticipatory bail to the petitioner.

Taking into consideration the facts aforesaid, let petitioner no.1, namely, Surajdev Yadav @ Surya Dev Yadav, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Gaya in connection with Khizersarai P.S.
