JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 17-09-2022 The learned counsel for the petitioners is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Khiri More P.S. Case No. 94 of 2021, registered for offence punishable under sections 147, 148, 186, 188, 323, 353, 337, 504 and 506 of the Indian Penal Code.

As per allegation, the accused persons including the petitioners committed chaos at the time of counting of votes of Mukhiya election. The accused persons also pelted stones etc. and some police personnel became injured.

The learned counsel for the petitioners has submitted that

No.11734 of 2022(2) dt.17-09-2022 2/2 some malpractices were done at the instance of the informant in counting of votes and in this respect Meena Devi firstly filed CWJC No. 18781 of 2021 and thereafter she filed an election petition. He has submitted further that on similar footing Mahesh Mistri @ Mahesh Vishwakarma has been granted anticipatory bail by this Court in Criminal Miscellaneous No. 8346 of 2022 on 01.09.2022.

Considering the above-mentioned facts and circumstances, the petitioners above-named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Danapur District-Patna in connection with Khiri More P.S. Case No. 94 of 2021, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
