31-08-2021 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Jamui P.S. Case No. 346 of 2017, registered for the offence under Sections 302, 201, 34, 120(B) of the Indian Penal Code.

As per the prosecution case, the petitioner, being husband of the deceased / victim, is alleged to have tortured her physically and mentally and made her traceless. The informant, who is sister of victim, suspects that her sister has been killed by this petitioner and his family members and they disposed her dead body.

It is submitted on behalf of petitioner that as a matter of fact, the informant and her family members, after concealing

No.21867 of 2021(3) dt.31-08-2021 2/2 the fact of previous marriage of victim lady, fraudulently married her with this petitioner and thereafter, they started extorting money from this petitioner. It is further submitted that the informant's sister (victim) was caught red handed with somebody in sexual act and after which, the petitioner had lodged an information with S.H.O., Ranibagh (Annexure - 2) and thereafter, they never lived together as husband and wife. There is no material on record to suggest that the petitioner either killed or kidnapped his wife (victim). Petitioner is in custody since 11.01.2021. Chargesheet has been submitted. However, learned A.P.P. for the State vehemently opposed the bail petition and submitted that the petitioner, being husband, is under obligation to explain the circumstances, under which, his wife fled away from the house and whereabouts of his wife.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
