JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-04-2019 Earlier prayer for bail of the petitioner was rejected twice vide order dated 22.1.2015 passed in Cr.Misc.No. 2487 of 2015 and vide order dated 20.9.2018 passed in Cr.Misc.No. 47025 of 2018. Allegation against the petitioner is of firing on the nephew of the informant.

Submission of learned counsel for the petitioner is that he is in custody for five years and trial has not been concluded as yet.

Heard learned APP and perused the report, from which it appears that six witnesses have been examined and I.O. is still to be examined in this case.

In such view of the matter, I am not inclined to grant bail to the petitioner.

However, learned trial court is directed to expedite the

No.14809 of 2019(4) dt.24-04-2019 2/2 trial and at the same time, Sr.Superintendent of Police, Patna is directed to ensure the presence of the witnesses in court on the date fixed so that the trial may be concluded at the earliest as the petitioner is in custody for five years.

Learned trial court as well as the Sr.Superintendent of Police, Patna is directed to submit report to this Court within two months about the progress of the trial.

With the above observation, this application is dismissed.
