The petitioners seek regular bail in connection with Bhargama P.S.Case No.71 of 2019 registered for offences punishable under Sections 302 and 120(B)/34 of the Indian Penal Code.
Allegation against the petitioners is of assault by lathi and rod to the deceased and there is specific allegation against the petitioner nos. 3 (Chand Kishore Das @ Chandra Kishore Das) and one Manoj Das of assault by lathi and the legs to the deceased.
Patna High Court CR. MISC. No.9046 of 2020(2) dt.03-03-2020 2/2 Submission of the learned counsel for the petitioners is that altogether 15 accused persons are named. There is general allegation against all except the petitioner no.3 and only four injuries were found on the person of the deceased. Petitioners are in custody since 9.12.2019. Charge sheet has been submitted.
Heard learned A.P.P., who has opposed the prayer for bail on the ground that there are allegations of assault and the cause of death is throttling.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sri Kumud Ranjan, J.M. Ist Class, Araria in connection with Bhargama P.S.case No.71 of 2019.
Accordingly, this application is allowed.
