JUSTICE ANIL KUMAR SINHA ORAL ORDER 17-06-2021 Heard Mr. Ajay Kumar Thakur, learned counsel for the petitioner and Mr. Nawal Kishore Prasad, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Karja PS Case No. 322/2020 registered for the offence punishable under Sections 272, 273, 34 of the IPC and Section 30(a) of the Bihar Prohibition and Excise Act, 2018.
The allegation, as per First Information Report, is that the police raided the house of the petitioner and recovered 169 litres of illicit foreign liquor as well as currency notes of Rs. 7,19,500/-.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to village
Patna High Court CR. MISC. No.21975 of 2021(3) dt.17-06-2021 2/3 politics inasmuch as petitioner happens to be Sarpanch of Gram Panchayat. Learned counsel further submits that husband of the petitioner has also been made accused and the petitioner has been dragged in this case merely because she being a lady was present in the house at the time alleged raid. Learned counsel next submits that petitioner has got no criminal antecedent of similar nature and she is in custody since 28.12.2020 and the charge-sheet has already been submitted in the matter.
Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is a lady and has got no criminal antecedent and the charge-sheet has already been submitted in the matter and further there is no likelihood that the petitioner will abscond or tamper with the evidences if she is released on bail, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, SAVITA DEVI be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Karja PS Case No. 322/2020.
It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines of
