In this case, the petitioners are seeking anticipatory bail in connection with Deep Nagar P.S. Case No. 254 of 2018, registered for the offence under Sections 272, 273, 291/34 of the Indian Penal code and under Section 30(a) of the Bihar Prohibition and Excise Act.

Allegation has been made that about 21 litres of liquor has been recovered from six persons including these petitioners.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedent.

No.10533 of 2020(2) dt.03-03-2020 2/2 Looking to the quantum of liquor as well as the fact that the petitioners have no criminal antecedent, let the petitioners, above named, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the 3rd Additional Sessions Judge -cum- Special Judge (Excise), Nalanda at Biharsharif, in connection with Deep Nagar P.S. Case No. 254 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. However, at the time of accepting bail bonds, the court below would verify and assure itself regarding the criminal antecedent of the petitioners. If they are having clean antecedent, then their bail bonds would be accepted. If they are found to be involved in any other case before filing of this application i.e. 13.02.2020 then their bail bonds would not be accepted.
