The petitioner is accused in connection with Ahiyapur P.S. Case No. 311 of 2015, registered under Sections 394, 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that it would appear from the F.I.R. that on the basis of written report of informant, Abdhesh Sah, Ahiyapur P.S. Case No. 311 of 2015, was instituted under Sections 394, 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act, regarding the murder of his wife against Javed Akthar and three unknown but in course of investigation, confessional statement of informant was recorded as detailed in paragraph 34 of the case diary, in which, he
Patna High Court Cr.Misc. No.6510 of 2017 (3) dt.22-03-2017 confessed his guilt about committing the murder of his wife saying that this petitioner shot fire at his wife. Except the confessional statement of informant, Abdhesh Sah, nothing has been collected by the Investigating Officer showing involvement of the petitioner in the present case. Further submission is that petitioner has no criminal antecedent.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 311 of 2015. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
