The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per allegations in the FIR, on a raid being conducted, 30 litres of country liquor, utensils and machines used for manufacture of liquor were recovered and three accused persons including the petitioner were taken into custody.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has no concern with the recovered article nor with the place of recovery. He is in custody since 30.12.2020
Patna High Court CR. MISC. No.21653 of 2021(2) dt.15-09-2021 2/2 and has no criminal antecedent. Charge sheet has been submitted in the case.
Heard learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the period in custody and the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Rajaoli P.S. Case no. 596 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II-cum-Special Judge, Excise, Nawada.
