The Petitioner seeks bail in Babubarahi P.S.

Case No. 15 of 2016, pending in the Court of Additional Chief Judicial Magistrate-II, Madhubani instituted for the offence under Section(s) 419, 420 of the Indian Penal Code. There is allegation against this petitioner that while acting as B.C. agent of North Bihar Rural Bank, he collected money from different depositors and did not deposit the aforesaid amount and has defalcated an amount of Rs. 5,50,000/-. The list of the depositors has been enclosed with the written report. Learned A.P.P. has submitted that in paragraphs 36, 37, 38 of the case diary the depositors have stated that petitioner collected the money from them but has not deposited the

Patna High Court Cr.Misc. No.11110 of 2017 (3) dt.13-04-2017 2/2 same in the bank.

In such circumstance, this Court is not inclined to grant bail to the petitioner at this stage. The application with regard to prayer of the petitioner for bail stands dismissed. The Court below is directed to expedite the trial.
