The petitioner apprehends his arrest in connection with Vaishali (Belsar O.P.) P.S. Case No.345 of 2019 registered for offences under Sections 364, 302, 201 and 120B/34 of the Indian Penal Code.
The petitioner is not named in the FIR and subsequently, an application was filed by the informant who is brother of the deceased who says that the petitioner along with others was involved in the murder but no material has come during investigation to connect the petitioner with the crime. The petitioner claims to be a businessman and has clean antecedent.
Considering the aforesaid fact, this application for
Patna High Court CR. MISC. No.11445 of 2022(2) dt.22-03-2022 2/2 anticipatory bail is allowed.
Accordingly, let petitioner, above-named, in the event of his arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali (Belsar O.P.) P.S. Case No.345 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
The court below is directed to accept the bail bond of the petitioner provisionally and after verifying the fact as to whether the petitioner has clean antecedent, the court below shall confirm the provisional bail and if it is found that the petitioner has criminal antecedent, then his bail bond shall be cancelled and he shall be taken into custody forthwith.
